Will of Charles Dunbrack (1795-March 18, 1861)

Proved on Friday the 2nd day of April A.D. 1869 upon the deposition of Peter Dunbrack one of the (sub ) and witnesses.

In the name of God, Amen!

I, Charles Dunbrack of Musquodoboit, County of Halifax, Province of Nova Scotia, Yeoman, being weak of body, but sound of mind and calling to my mortality, do give and bequeath whatever property God had endued with, in manner following, With respect to my real estate I give and bequeath to my son James, the land lying west of the main road, and bounded by said main road, the old road and Saml Dickey’s line, also that piece lying on east side of said road bounded by N. G. Lydiard’s line, the main road, and a line running from spout in main road parallel to side lines of Meagher’s Grant, until it intersects a line drawn from N. G. Lydiard’s line at right angles one rod west of the single apple tree.

To my eldest son John in consideration of his dutiful care of his mother and myself for a number of years past, I give and bequeath the remainder of my farm, subject to the following conditions 1st That he allow hsi brother James the privilege of pasture for four or five head of cattle and twelve sheep and timber for fuel, fencing, and building, this privilege not to be transferred. 2nd That he is to take care of and provide for his mother my beloved wife Mary, to furnish her during the term of her natural life with comfortable diet, and clothing, to allow her the possession of the east end of the house we now occupy and part of the cellar, or a room in any house he may occupy herafter, to maintain two cows and six ewes for her use, to provide fuel for her use, and to perform all the duties that a mother may expect from a dutiful son.

With respect to my other children, my daughters, Elizabeth, Mary, Isabella, and Catharine, and my sons, Alexander, Peter, Charles, and Angus, I leave them my blessings, and direct my sones, John and James to pay them five shillings each as my circumstances prevent a larger bequest.

ANd I hereby constitute and appoint my sons -- John and James Dunbrack executors of this my last Will and Testament.

In witness whereof I have hereunto my hand and seal subscribed and affixed on the fifth day of March, in the year of Our Lord one thousand eight hundred and sixty one.
